2. Product Information & Compliance
a. Hemp-Derived Products: All products sold by Cali Farms are made from federally compliant hemp as defined by the Hemp Regulation and Modernization Act of 2025 ("2025 Hemp Bill"), containing no more than 1.0% total THC (inclusive of Delta-9 THC and THCA) on a dry-weight basis.
b. THCA and Other Cannabinoids: Some products naturally contain THCA and other cannabinoids that may convert to Delta-9 THC when heated or metabolized. By purchasing, you accept and assume all responsibility for potential intoxicating effects.
c. Third-Party Testing & Transparency: Every batch is independently lab-tested for potency, purity, total THC, and compliance with the 2025 Hemp Bill’s total cannabinoid guidelines. Certificates of Analysis (COAs) are available upon request.
d. Federal Compliance Assurance: All Cali Farms products meet the updated federal definitions of lawful hemp per Section 297A of the 2025 Hemp Bill. However, individual states may impose stricter limits or cannabinoid restrictions, and you are responsible for knowing your local laws.

3. Age Restriction
Purchases from CaliFarmsShop.com are restricted to adults aged 21 or older. By placing an order, you confirm that you meet this age requirement.

4. Customer Responsibility & Legal Compliance
a. Know Your Local Laws: You are solely responsible for ensuring that possession or use of hemp-derived products is legal in your jurisdiction.
b. Shipping Restrictions: We do not ship to locations where hemp-derived cannabinoids or THCA are restricted or prohibited. Orders placed for such areas will be canceled and refunded, minus applicable fees.
c. Indemnification: You agree to indemnify and hold harmless Cali Farms, RAO LLC, employees, and affiliates from claims arising from:

• Violation of local, state, or federal hemp laws

• Misuse or resale of our products

• Regulatory actions taken against you post-purchase

• Future legal changes affecting cannabinoid legality
  d. Post-Sale Legal Changes: Laws may evolve after your purchase. Legal changes that render a product restricted or illegal in your jurisdiction do not entitle you to a refund.

5. Payment Policy & Fraud Prevention
a. Full Payment Required before processing or shipping.
b. Fraud Prevention: We actively detect and report fraudulent activity including chargebacks, false claims, or deceitful conduct. Violations may result in legal action and cooperation with enforcement agencies.

6. No Returns or Refunds
All sales are final once processed or shipped. Due to hemp industry compliance standards, we do not accept returns or offer refunds, except in the case of verified shipping or fulfillment errors.

7. Shipping & Delivery
a. Estimated Shipping: Delivery times are approximate and not guaranteed.
b. Lost or Damaged Shipments: We are not liable for packages lost or damaged by the carrier. Insurance claims must be filed directly with the carrier.
c. Government Seizures: Cali Farms and RAO LLC are not responsible for seizures or detentions by authorities based on changing interpretations of hemp policy.
d. Regulatory Enforcement: If authorities detain or destroy shipments due to updated federal or state rulings, the risk remains with the purchaser.
8. Wholesale & Reseller Disclaimer

Cali Farms operates as both a wholesale supplier and dropshipping provider. Resellers agree that:

• Cali Farms products are not FDA- or DEA-approved.

• You are responsible for labeling, marketing, and resale compliance in your state.

• Cali Farms and RAO LLC accept no liability for end-user claims or regulatory enforcement.

9. Health & Safety Disclosures
a. Not Medical Advice: Our products are not intended to diagnose, treat, cure, or prevent any disease. Consult a medical professional before use.
b. Natural Variability: Hemp is a natural plant; product characteristics may vary.
c. Drug Testing Advisory: Products may trigger a positive result for THC or cannabinoids. By purchasing, you accept this risk.
d. COA Accuracy Disclaimer: Testing reflects total THC content at the time of analysis, based on decarboxylated values per the 2025 Hemp Bill testing protocols.

10. Limitation of Liability
To the maximum extent permitted by law, Cali Farms and RAO LLC disclaim all liability for direct, indirect, or consequential damages related to:

• Use or misuse of hemp products

• Enforcement or seizure actions

• Regulatory updates post-purchase

• Lab variability or product testing discrepancies
  If liability cannot be waived, it shall be limited to the amount paid for the product.

11. Intellectual Property
All logos, images, product names, content, and source code are property of Cali Farms and RAO LLC. Reuse or reproduction without written consent is prohibited.

12. Governing Law
These Terms & Conditions will be governed by the laws of the State of Florida, with exclusive venue in its state or federal courts.

13. Severability
If any provision is found invalid, the remaining portions remain enforceable.

14. Entire Agreement
These Terms constitute the complete understanding between you and Cali Farms / RAO LLC regarding purchases and use of this website.
